  1. AT&T License Agreement
  2.  
  3. IMPORTANT: USE OF THIS AT&T DISK CONSTITUTES
  4. ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS.
  5.  
  6. 1. USE RESTRICTIONS: This product may be used a) by the 
  7. End User only and may not be made available for any 
  8. other use by any loan, rental, service bureau, or any other 
  9. arrangement and b) for reference purposes only.  Use for 
  10. direct mail, telemarketing, or the provision of directory 
  11. assistance service is strictly prohibited.

  13. 2. PROPERTY RIGHTS: End User acknowledges that the databases 
  14. are, and shall remain, the exclusive property of AT&T, 
  15. and that the End User has no rights in the databases other 
  16. than as set forth herein.  The databases or information 
  17. contained in them may not be sold, duplicated, transferred or 
  18. in any other manner commercially exploited.  End User agrees 
  19. to take reasonable measures to ensure that such     
  20. unauthorized use is not achieved.

  22. 3. PROPERTY RIGHTS IN AND RESPONSIBILITY FOR SOFTWARE: End 
  23. User acknowledges that the compact disks contain search and 
  24. retrieval software that Dirxion Software is hereby sublicensing to 
  25. End User on non-exclusive basis for the limited purpose of 
  26. reviewing the data contained on the compact disks.  End User 
  27. acknowledges that such software comprises valuable proprietary 
  28. and confidential information which is legally protected under 
  29. trade secret and copyright laws. End User is not authorized to 
  30. reverse compile or reverse assemble the software or otherwise 
  31. attempt to reveal the proprietary programming techniques and 
  32. structures used in the software.  End User is not authorized 
  33. to duplicate, transfer, sell or in any commercial manner, 
  34. exploit the Software.

  36. 4. DISCLAIMER OF WARRANTY AND LIMITED WARRANTY/FINAL 
  37. EXPRESSION OF AGREEMENT: THE COMPACT DISKS, DATABASES AND 
  38. SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND 
  39. INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF FITNESS 
  40. FOR ANY PARTICULAR PURPOSE OR WARRANTY OF MERCHANTABILITY.  
  41. AT&T DOES NOT WARRANT, GUARANTEE OR MAKE ANY 
  42. REPRESENTATIONS REGARDING THE USE OR RESULTS OF THE USE OR THE 
  43. MATERIALS IN TERMS OF THEIR ACCURACY, RELIABILITY OR 
  44. CURRENTNESS.  END USER ASSUMES THE ENTIRE RISK AS TO THE 
  45. RESULTS AND PERFORMANCE OF THE COMPACT DISK.  AT&T'S SOLE 
  46. LIABILITY SHALL BE TO REPLACE THE COMPACT DISK IN THE EVENT 
  47. THE COMPACT DISK ITSELF, AS OPPOSED TO THE SOFTWARE OR 
  48. DATABASE ENCODED THEREIN, IS DEFECTIVE.  IF FAILURE OF THE 
  49. MATERIALS HAS RESULTED FROM ACCIDENT, ABUSE OR MISAPPLICATION, 
  50. AT&T SHALL HAVE NO RESPONSIBILITY TO REPLACE THE 
  51. MATERIALS.  NEITHER AT&T NOR ANYONE ELSE WHO HAS BEEN 
  52. INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE 
  53. PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, 
  54. CONSEQUENTIAL OR INCIDENTAL DAMAGES  (INCLUDING DAMAGES FOR 
  55. LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF 
  56. BUSINESS INFORMATION AND THE LIKE) ARISING OUT OF THE USE OR 
  57. INABILITY TO USE     SUCH PRODUCT EVEN IF AT&T HAS BEEN 
  58. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  60. 5. GENERAL: Any cause of action brought by any party against 
  61. the other based upon the terms of the Agreement shall be 
  62. brought within one year of the accrual of the cause of action.  
  63. Any question concerning the validity, construction or 
  64. performance of the Agreement shall be governed by the laws of 
  65. the State of Georgia.

  67. PRIVACY STATEMENT
  68.  
  69. Dirxion Software respects the privacy of its customers and
  70. visitors.  Information from on-line use may be utilized, in
  71. aggregate, to measure the number of site visits, average time
  72. spent on sites, number of pages viewed and type of pages viewed.
  73. Customer-specific data will not be appended to this information.
  74. Some sites may contain external links; Dirxion Software is not
  75. responsible for content or privacy standards at other sites.  Due
  76. to the evolving nature of technology, we will continue to assess
  77. privacy needs and make changes as necessary to ensure that we
  78. maintain the highest standards.
